Contest Terms and Conditions

No purchase is necessary to participate in this promotion. A 90-minute sales presentation will be requested but not required for entry into our contest. Void where prohibited by law, rule or regulation.

Kubala Home Improvements will award one (1) grand prize at the end of the prize period. The prize period begins on December 20, 2023. Kubala Home Improvements timekeeping device shall be the official timekeeping device for this promotion. The grand prize winner will be determined from a random drawing of all entries received during the prize period. The random drawing shall occur on or about December 31, 2023. The odds of winning the grand prize are determined by the number of entries received prior to the time of the prize drawing. Kubala Home Improvements reserves the right at its sole discretion to suspend, modify, extend, or terminate this promotion without notice at any time. The grand prize winner will be notified by phone call and email. Return of any prize notification as undeliverable will result in disqualification and selection of an alternate grand prize winner. All prizes will be awarded.

The grand prize winner shall receive their selection of Kubala Home Improvements’ custom-made windows, professionally installed with a total maximum retail value of $25,000.00, as determined by Kubala Home Improvements based on its then-current price list. The grand prize is not transferable. Maximum retail value includes cost of installation. The grand prize must be installed at the address listed on the winning entry form. Installation must be provided by Kubala Home Improvements personnel or designee. All expenses not specifically provided for are the sole responsibility of the grand prize winner. Notwithstanding anything to the contrary in these Official Rules, if the grand prize winner has already purchased goods or services from Kubala Home Improvements, the grand prize winner may choose (i) the grand prize; or (ii) double the money back from their original purchase, up to $25,000 in cash.

Entrants may enter this promotion by completing the entry form and returning it to the drop box where the entrant obtained it, or by mailing it back to Kubala Home Improvements at 5 Pell Street, Ludlow, MA 01056. Alternatively, entrants may print their name and their complete address on a 3” x 5” card, write the words “KUBALA HOME IMPROVEMENTS’ SWEEPSTAKES ENTRY REQUEST” at the top, and mail the card to Kubala Home Improvements at 5 Pell Street, Ludlow, MA 01056. Mailed entries must be postmarked by November 27th, 2023. No more than one entry per household is allowed. Kubala Home Improvements is not responsible for any illegible, misplaced, damaged or late entries. The address listed on each entry form must be the address where the grand prize is to be installed if such entry is selected as the grand prize winner.

Entrants must (i) be legal residents of the United States; (ii) be 18 years of age or older, (iii) own their own home, which home is in a suitable condition (as determined by Kubala Home Improvements or its designees) for installation of the grand prize (including compliance with local building codes and regulations), and (iv) reside in a geographic area in which Kubala Home Improvements is permitted to install the grand prize at the grand prize winner’s location. Employees, officers and directors of Kubala Home Improvements, its affiliates, subsidiaries, co-branded partners, consultants, contractors, advertising, public relations, promotion, fulfillment and marketing agencies, their immediate families (and those living in their same households) are not eligible to participate in this promotion. The grand prize winner’s house must be in suitable condition for installation (e.g., no water, mold,structural damage, etc.). Any waterproofing, remediation or other repairs necessary for proper installation (as deemed by Kubala Home Improvements or its designees in their sole discretion) must be performed at the grand prize winner’s expense prior to installation. Installation labor does not include painting or staining. No transfers, substitution in prizes or cash will be allowed except by Kubala Home Improvements, who may substitute a prize of equal or greater value in its sole or absolute discretion. Cash value of the prize is deemed to be $25,000.00. Upon installation of the grand prize, Kubala Home Improvements will be deemed to have awarded the grand prize to the grand prize winner with the grand prize winner assuming full ownership and responsibility for the grand prize. The grand prize winner must arrange for prize installation no later than one month following the award of the grand prize and installation must occur and be completed within twelve months of confirmed notification.

The grand prize winner must comply with all instructions in the prize notification correspondence, including the completion of an affidavit of eligibility and liability/publicity release, and return such within fourteen days of the date on the prize notification correspondence as well as have met all of the eligibility requirements set forth within these Official Rules; otherwise grand prize will be forfeited and an alternate grand prize winner will be selected. Acceptance or use of the grand prize constitutes permission for Kubala Home Improvements and its affiliates to use recipients name and likeness for advertising and promotional purposes without compensation, unless otherwise prohibited by law. Liability for any applicable taxes, including all federal, state, and local taxes and/or other fees that may apply to the grand prize are the sole responsibility of the grand prize winner. Any required tax reporting forms will be furnished to the Internal Revenue Service. All expenses not specifically provided for by Kubala Home Improvements in these Rules are the sole responsibility of the grand prize winner. You understand that by entering contest you are providing an electronic signature, you certify that all of the information provided in this application is true and correct, and you are confirming you have read and understand the Privacy Policy and Application Disclosure, and you are providing written instructions to this company under the Fair Credit Reporting Act authorizing this company to obtain information from your personal credit profile or other information from Experian and/or TransUnion and/or Equifax.

You authorize this company to obtain such information solely to conduct a pre-qualification for credit. Entries that are lost, late, illegible or incomplete for any reason will not be eligible. Kubala Home Improvements reserves the right to disqualify any entry in good faith. In the event of a dispute concerning the identity of the person submitting an entry, the entry will be deemed to be submitted by the person in whose name the winning home is titled. For the winner’s list, mail a self-addressed, stamped envelope within 30 days following the prize period to Kubala Home Improvements at 5 Pell Street, Ludlow, MA 01056 including a request for the winner’s names.

By participating in the promotion, participants agree to release, discharge and hold harmless Kubala Home Improvements, its affiliates, co-branded partners, subsidiaries, retailers, agencies and their respective officers, directors, employees and agents, from any damages that may arise out of participation in the promotion in any way or out of the acceptance, use, misuse or possession of a prize. Acceptance of a prize may require entering a standard contract or purchase order for the goods and services to be provided, as required by state law. This promotion is conducted in English (which will be given its everyday ordinary meaning). This Sweepstakes is sponsored by Kubala Home Improvements at 5 Pell Street, Ludlow, MA 01056/ 1-855-458-2252 and governed by the laws of the United States with a venue in Hampden County Massachusetts.

By claiming this prize, the winner authorizes the use, without additional compensation, of his or her name and/or likeness and/or voice/photograph and municipality of residence for promotion and/or advertising purposes in any manner and in any medium (including, without limitation, radio broadcasts; newspapers and other publications; television or film releases; slides; videotape; distribution over the internet; and picture date storage) the contest sponsors may deem appropriate.

Winner, if eligible, must accept or decline the prize within 48 hours. Should prize notification go unanswered or be undeliverable, this will result in disqualification and selection of an alternate grand prize winner.
